Terms of use.
These terms govern your use of SME24 and everything you order through it. Accepting them at sign up is what makes them binding.

Who the agreement is with
SME24 is operated by IC Hotz GmbH, Obermühle 5, 6340 Baar. Where you sign up on behalf of a company, you confirm you may bind that company, and the agreement is with it.
What we provide
A benchmark of your company's safety and health position against Swiss peer data, and, where you buy one, a fixed price package delivered by a qualified expert. The benchmark is free and is computed from public research and the figures you supply.
Experts are qualified professionals engaged by us. We select and assign them; you do not contract with them directly.
Your account
Keep your credentials to yourself and tell us if you think someone else has them. You are responsible for what happens under your account. One person, one account: do not share a login across a team.
The figures you enter drive the benchmark. Enter them honestly, because a benchmark built on wrong numbers is worse than none.
Packages, prices and payment
Prices are shown in Swiss francs and include Swiss VAT at the rate in force. Payment is due at checkout by card, or on the invoice terms stated on it. You get an invoice for every order.
We schedule the assessment with you after payment. If we cannot deliver within a reasonable period we will say so and refund you.
Purchased contacts
Expert accounts may buy credits and reveal contacts from our licensed directory of safety and operations people. A revealed contact may be used for the expert's own business development only: to approach that person with the expert's own services.
Contacts may not be resold, shared, passed to a third party or added to any list or tool that serves anyone but the expert who revealed them.
Bulk extraction of the directory beyond the export of one's own revealed contacts is not permitted; the search exists to find people, not to copy the list.
When a person asks not to be contacted, or we remove them from the directory, the expert stops using the contact. A removal is not refunded.
The expert is responsible for complying with the marketing and data protection law of the contact's country, including any rule on unsolicited business email.
Changing or cancelling
Tell us at least five working days before a scheduled assessment and we will move it at no cost. Later than that, or a no show, and we may charge for the expert's reserved time.
If we have not started work you can cancel and be refunded in full.
What we need from you
Access to the site, the documents and the people the assessment needs, at the time agreed. An expert who cannot see the workplace cannot assess it.
You remain responsible for safety at your workplace. Our advice supports your duties under Swiss law; it does not take them over.
What belongs to whom
The reports, benchmarks and documents we deliver are yours to use inside your company. The platform, the methodology and the peer data behind them stay ours.
We may use figures from your company in anonymous aggregate form to improve the peer data. Nothing published this way identifies you or your company.
Liability
We are liable for damage we cause intentionally or through gross negligence, and for injury to life, body or health, without limit. For anything else our liability is limited to the amount you paid us in the twelve months before the event.
The free benchmark is an indication built from public data and your own figures. It is not a legal audit and not a substitute for an assessment. Decisions you make from it alone are yours.
Ending the agreement
You can close your account at any time from the app or by writing to us. Orders already placed are completed and paid for as agreed. We can suspend or close an account that breaches these terms, and will say why.
Changes to these terms
We may change these terms. If a change is substantive we raise the version and ask you to accept the new one when you next sign in, showing you what changed. Continuing to use the service after that means the new terms apply.
The current version is 2.
Law and jurisdiction
Swiss law applies, without its conflict of law rules. The courts of Baar have jurisdiction, unless mandatory law gives you a different forum.
